Architects remain silent in copyright infringement case

Dublin architects O'Donnell + Tuomey have so far refused to comment after they were caught using, without authorisation, a photographer's image for the promotion of the Photographers' Gallery upcoming new space

More than five months after photographer John Goldsmith found out that a photograph he had taken had been used by O'Donnell + Tuomey for the promotion of the Photographers' Gallery space in London, the Dublin architects have yet to contact the photographer or comment on the issue.

Frustrated by a lack of response from the gallery and its architects, Goldsmith publicly announced the copyright infringement last week. The Photographers' Gallery, which had also been informed of the infringement in October 2010, was, this time, forced to issue a public statement condemning the illegal use of Goldsmith's image.

However, the architects have so far refused to comment, despite our numerous requests. Monika Hinz, office manager at O'Donnell + Tuomey, tells BJP that the firm "cannot offer any further comments on this issue as we are in the process of contacting the photographer at present and hope to talk to him this week."

O'Donnell + Tuomey has also refused to comment when BJP enquired on the reasons behind the architects' silence to Goldsmith's earlier requests for compensation. The photographer first contacted O'Donnell + Tuomey in October 2010.

According to the Photographers' Gallery, it learned of the unauthorised use from the architects at that time. "We removed it from our website immediately and stopped further distribution," said the gallery's director Brett Rogers. "At the same time O'Donnell & Tuomey removed it from all the websites and files under their control. The Gallery apologized to Mr Goldsmith on 18 January."
